Late yesterday, the DOL released the explanatory notice referred to in the Families First Coronavirus Response Act (FFCRA). The notice is mandatory. It must be posted by all covered employers immediately. The notice can be found here. The following is some additional information provided by the DOL. The Notice must be posted in a conspicuous place on the employer’s premises.

Satisfy this requirement by:

  • Posting the notice in a lunchroom or other space accessible to all employees
  • Emailing or direct mailing this notice to employees
  • Posting this notice on an employee information internal or external website

Since the FFCRA takes effect on April 1, this notice does not need to go to employees already laid off. Although it does not need to go to the applicant, it does need to go to any new hire either by email, direct mail, posting this notice on the premises, or on an employee informational website.
